Wisper AI: Flow Voice-to-Text — Terms of Service

Please read these Terms of Service ("Terms") carefully before using Wisper AI: Flow Voice-to-Text ("the App"), a voice-to-text application developed by Candy Studio Apps ("we", "us", "our").
These Terms apply to the Wisper AI: Flow Voice-to-Text app for Solana Mobile, distributed through the Solana dApp Store. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and Candy Studio Apps. The language of this agreement is English.
1. DESCRIPTION OF SERVICE
Wisper AI: Flow Voice-to-Text is a voice-to-text dictation tool for Android that:
- Records your voice when you tap the record button;
- Transcribes your speech using AI-powered services;
- Cleans and polishes the transcribed text;
- Inserts the result into the text field you are currently using;
- Stores your transcription history locally on your device.
The App uses a floating bubble overlay and Android's Accessibility Service to provide dictation across other applications on your device. It does not replace your keyboard.
2. ELIGIBILITY
You must be of legal age to enter into a binding contract under the laws of your country of residence. If you are a minor, you may only use the App with the consent of a parent or legal guardian who accepts these Terms on your behalf.
By using the App you also confirm that you are not located in, or a resident of, a country subject to comprehensive sanctions, and that you are not listed on any applicable sanctions list.
3. PREMIUM ACCESS AND ON-CHAIN PAYMENTS
The App offers a free tier and premium access:
- Free tier: a limited number of voice transcriptions per period, as determined by our current offering and displayed in the App.
- Premium: unlimited voice transcriptions and the AI writing tools, unlocked by payment.
3.1 How payment works
Premium access is bought on-chain from a Solana wallet you connect yourself, using the Solana Mobile Wallet Adapter. You are solely responsible for your wallet, your seed phrase and your private keys. We never ask for them, never receive them, and cannot recover them if they are lost. We do not hold or custody your funds.
3.2 Prices and fees
Prices and what each purchase includes are shown in the App before you confirm. Amounts may be quoted in USD and charged in SOL or USDC at the rate displayed at the time of purchase. You also pay Solana network fees, which go to the network and not to us.
3.3 Finality
Blockchain transactions are final and irreversible. Once a transaction is confirmed we cannot reverse it, and we cannot recover funds sent to a wrong address, on an unsupported network, or in an unsupported token. Access is unlocked once the transaction is confirmed on-chain; confirmation can be delayed by network congestion. If a confirmed payment does not unlock your access, email choizzyio@gmail.com with the transaction signature and we will resolve it.
3.4 Renewal and cancellation
Where the App offers a recurring plan, it continues only while you authorise a new on-chain payment. There is no store-managed automatic renewal, so there is no store subscription to cancel — simply stop authorising payments.
3.5 Refunds
Payments are not processed by an app store, so there is no store refund flow. EU/EEA and UK consumers have a statutory 14-day right of withdrawal for digital content, which is lost once delivery begins with your express consent. Beyond that, purchases are non-refundable except where required by law. For any billing problem, contact us at choizzyio@gmail.com.
4. ACCEPTABLE USE
You agree not to use the App to:
- violate any applicable laws or regulations;
- transmit harmful, offensive, defamatory, or illegal content;
- attempt to reverse-engineer, decompile, or modify the App;
- interfere with the App's operation or security;
- use the Accessibility Service for any purpose other than the intended dictation functionality;
- exploit the App to circumvent security features of other applications;
- use the App in a way that violates the terms of service of any third-party platform where you are dictating text;
- record any person or conversation you have no legal right to record;
- launder money, finance illegal activity, or evade sanctions or any applicable financial regulation.
We reserve the right to suspend or terminate access for material violations of these Terms.
5. INTELLECTUAL PROPERTY
All intellectual property rights in and to the App — including its source code, design, graphics, user interface, and original branding elements — are owned by Candy Studio Apps or our licensors, and are protected by applicable intellectual property laws.
You retain full ownership of any text content you create through dictation. We do not claim any rights over your transcriptions.
Third-party trademarks, service marks, and trade names referenced in the App, including those of OpenAI, Anthropic, Google, Solana and others, remain the property of their respective owners.
6. AI-GENERATED CONTENT
The App uses artificial intelligence to transcribe and clean your dictated speech, and to generate summaries, rewrites and other AI outputs you request. By recording or running an AI feature, you consent to your audio and the resulting text being processed for that purpose, as described in our Privacy Policy. You acknowledge that:
- AI processing may occasionally produce inaccurate, incomplete, or unexpected results;
- You are solely responsible for reviewing and editing transcribed text before sending, publishing, or acting upon it;
- We do not guarantee the accuracy, completeness, or appropriateness of AI-generated output;
- AI-cleaned text should not be relied upon for legal, medical, financial, or safety-critical communications without human review;
- AI output may reflect biases or errors present in the underlying models.
7. ACCESSIBILITY SERVICE
The App requires the Android Accessibility Service to insert dictated text into other applications. By enabling this service, you acknowledge and agree to the following.
The Accessibility Service is used exclusively for: detecting text field focus, detecting keyboard visibility, identifying which application is currently in the foreground, and inserting transcribed text into the active text field.
When you paste dictated text using the floating bubble, the App collects limited metadata about the destination application: the package name (for example, "com.whatsapp"), the application display name, the character count of the pasted text, and a timestamp. This metadata displays app icons in your Library and usage statistics in the Insights tab. It is stored only on your device and is never transmitted to our servers or shared with third parties.
The App does not read, collect, or store the actual text content you paste into other applications. The App does not read, collect, or store any other content visible on your screen, including notifications, messages, emails, chat history, passwords, payment information, or browsing activity. The App does not monitor apps running in the background.
You can disable the Accessibility Service at any time in your device Settings; doing so will disable the floating bubble feature. You can disable app metadata collection separately at any time in App Settings, under Privacy. Full details are in our Privacy Policy.
8. THIRD-PARTY SERVICES
The App relies on third-party services for core functionality:
- OpenAI — speech-to-text transcription
- Anthropic — AI text cleanup and formatting
- Google Firebase — analytics, crash reporting, push notifications
- Amplitude — product analytics
- Solana RPC and blockchain infrastructure — reading and submitting on-chain payments
These services have their own terms of service and privacy policies. We are not responsible for the practices, availability, or performance of third-party providers.
9. DISCLAIMERS AND LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not control the Solana network, your wallet application, or any RPC or infrastructure provider, and we do not guarantee that the network will be available, timely, or free of congestion or fees.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, missed communications, transcription errors, or losses arising from an on-chain transaction, wallet failure, or network event outside our control. Our aggregate liability arising from or relating to the App shall not exceed the total amount you paid us for the App in the 12 months preceding the claim.
Nothing in these Terms limits or excludes liability for (a) death or personal injury caused by our negligence, (b) fraud, (c) willful misconduct or gross negligence, or (d) any other liability that cannot be limited or excluded under applicable law. Statutory consumer rights remain unaffected.
10. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Candy Studio Apps from any third-party claims, damages, losses, or reasonable expenses arising from (a) your violation of these Terms, or (b) your use of the App in violation of applicable law.
11. TERMINATION
We may suspend or terminate your access to the App in the event of a material breach of these Terms. Upon termination, your right to use the App ceases immediately. Locally stored data remains on your device unless you delete it.
You may stop using the App at any time by uninstalling it and disconnecting your wallet. Uninstalling does not and cannot remove transactions already recorded on the Solana blockchain.
12. CHANGES TO THESE TERMS
We may modify these Terms from time to time. Material changes will be communicated through an in-app notice or notification. The latest version is always available on this website. Continued use of the App after the effective date of changes constitutes acceptance of the revised Terms.
13. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the Republic of Poland. Any disputes shall be subject to the exclusive jurisdiction of the common courts in Warsaw, Poland, without prejudice to any mandatory consumer-protection laws that may apply in the user's country of residence.
14. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
